Personal Injury Claimants Lose Out in Club Collapse
It has been revealed by administrators that as part of the winding up order placed on what was Britain's biggest nightclub group, until it went bust 18 months ago, those who had brought personal injury claims against the brand will lose almost all of the first £15,000 of their claims.
The claims for personal injury, thought to number 123, were brought against Luminar prior to its collapse and are now set to be handled by the insurance brokers JTL. Unfortunately though the insurance policy does not cover the first £15,000 of any claim and so this excess, for which Luminar would have liable for now becomes a non-preferential claim in administration. This means that only a fraction of the value claimed for will be recouped by the claimants.

An ankle injury for example, could receive personal injury compensation of up to £35,200, whilst hand injuries could be open for a personal injury claim of over £20,000.
There had been a further nineteen personal injury claims received which are in relation to accidents and incidents which occurred during the interim period in which E&Y Administrators ran Luminar's clubs. It is understood that the £15,000 excess which applies on these claims however will not be affected and will be out paid in full.
Luminar had been known to be struggling to stay afloat for some time before their eventual collapse in late 2011. In addition to their own debts the business was also struggling to adapt to changes in the spending habits of young adults, with less and less people spending largely on nightclubs and late night venues.
A large number of Luminar's 79 clubs and venues were sold on within months of the business failing, saving around 3,000 jobs. But the huge debts left by its predecessor mean that it could be the people who once flocked there who are hit the hardest, particularly those looking to seek personal injury compensation.
